Terms of Service
1.0. Introduction
Welcome to Shakarra Technology Limited, doing business as Shakarra ("Shakarra," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website (the "Site") and our services, which allow users in Nigeria to purchase products from leading U.S. retailers, including Walmart, Amazon, Costco, Home Depot, Target, and Best Buy, in Nigerian Naira (NGN). By accessing or using our Site or services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.
These Terms apply to all users, including visitors, registered account holders, and customers. You must create an account to complete purchases on our Site. We reserve the right to update these Terms at any time, with notice provided via the Site or email. Your continued use of the Site or services after changes constitutes acceptance of the updated Terms.
2.0. Eligibility
To use our Site or services, you must:
- Be at least 18 years old or have parental/guardian consent if under 18.
- Be a resident of Nigeria or have a valid Nigerian shipping address.
- Provide accurate and complete information when creating an account or placing orders.
- Comply with all applicable laws, including those of Nigeria and any relevant international jurisdictions.
We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, including for violations of these Terms or suspected fraudulent activity.
3.0. Accounts on Shakarra
3.1. Account Registration.
To make a purchase, you must create an account on the Site. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials (username and password).
- Notify us immediately of any unauthorized use of your account at support@shakarra.com.
- Be responsible for all activities conducted under your account.
You may not transfer or share your account with others. We may suspend or terminate your account if we believe you have violated these Terms or engaged in unlawful activity.
3.1. Account Deletion
You may delete your account at anytime, provided you don't have a pending order or a dispute yet to be resolved. If you do have trouble deleting your account, you can reach out to oue support team by contacting support@shakarra.com
We delete the following data from our platform:
- Your account name, email and password
- Your delivery address(s) and order history
- Dispute information if any
4.0. Orders and Payments.
4.1. Placing Orders.
When you place an order, you agree to:
- Purchase products for personal use only, not for resale or commercial distribution.
- Provide accurate billing and shipping information.
- Pay all applicable fees, including product prices, shipping costs, taxes, duties, and any currency conversion fees, in Nigerian Naira (NGN).
Orders are subject to availability from our partner retailers (e.g., Walmart, Amazon). We reserve the right to cancel or modify orders if products are unavailable, mispriced, or if there are errors in the order process.
4.2. Pricing.
Prices are displayed in NGN and include the cost of sourcing products from U.S. retailers, currency conversion, and applicable fees. Prices are subject to change without notice, but changes will not affect confirmed orders. We strive to ensure pricing accuracy but are not liable for typographical errors.
4.3. Payment.
We accept payments via approved methods (e.g., credit/debit cards, bank transfers, mobile money) processed by secure third-party payment providers (e.g., Paystack, Flutterwave). You authorize us to charge your chosen payment method for all applicable charges. Payment must be completed before we process your order.
4.4. Order Confirmation.
After placing an order, you will receive a confirmation email. This does not guarantee order fulfillment, as orders are subject to stock availability and verification. If we cannot fulfill your order, we will notify you and issue a refund for any payments made.
5.0. Sharing and Delivery.
We facilitate the delivery of products from U.S. retailers to Nigeria through third- party shipping providers (e.g., DHL, UPS). You agree to:
- Provide a valid Nigerian shipping address.
- Pay all shipping fees, customs duties, and taxes as indicated at checkout
- Comply with Nigerian import regulations.
Delivery times are estimates and may vary due to factors beyond our control (e.g., customs delays, shipping carrier issues). We are not liable for delays, but we will work with you to resolve issues. Risk of loss or damage transfers to you upon delivery to the shipping address.
6.0. Returns, Refunds, and Cancellations.
6.1. Cancellations.
You may cancel an order before it is processed for shipping by contacting support@shakarra.com. Once an order is processed, cancellation may not be possible. We reserve the right to cancel orders due to unavailability, pricing errors, or suspected fraud, with a full refund issued.
6.2. Returns.
Returns are subject to the policies of the U.S. retailer from which the product was sourced. If a return is permitted, you must:
- Contact us within 14 days of delivery to initiate a return.
- Return the product in its original condition and packaging.
- Pay any return shipping costs, unless the product is defective or incorrect.
6.3. Refunds.
Refunds, if approved, will be processed to your original payment method within a reasonable timeframe (typically 7-14 business days). Refunds exclude shipping fees, duties, or taxes. Shakarra reserves the right to choose what method the customer gets their refund. Available method includes refunds through customer wallets on the app, reward points and also cash transfers.
7.0. Intellectual Property.
Your data may be transferred to and stored in jurisdictions outside Nigeria, including the United States (for interactions with U.S. retailers) and other countries where our service providers operate. We ensure that such transfers comply with NDPA requirements, such as using adequacy decisions, standard contractual clauses, or other approved mechanisms to protect your data.
8.0. User Conduct.
You agree not to:
- Use the Site or services for unlawful purposes or in violation of these Terms.
- Attempt to access, interfere with, or disrupt the Site, servers, or networks.
- Engage in fraudulent activities, including using stolen payment methods or misrepresenting your identity.
- Post or transmit harmful, offensive, or infringing content.
- Use automated tools (e.g., bots, scrapers) to access or extract data from the Site.
We may suspend or terminate your access for violations of these rules.
9.0. Third-Party Services.
Our services involve third parties, including U.S. retailers, payment processors, and shipping providers. These parties operate under their own terms and policies, which you must review and accept. We are not responsible for their actions, omissions, or service interruptions.
Links to third-party websites are provided for convenience. We do not endorse or control these sites and are not liable for their content or practices.
10.0. Limitation of Liability.
o the fullest extent permitted by law, Shakarra, its affiliates, officers, directors, employees, and agents are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or services, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim is limited to the amount you paid for the specific order giving rise to the claim.
We are not liable for:
- Errors, delays, or failures caused by third parties (e.g., retailers, shipping providers).
- Inaccuracies in product descriptions or availability provided by U.S. retailers.
- Losses due to events beyond our control (e.g., natural disasters, customs delays).
11.0. Disclaimer of Warranties.
The Site and services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure, or that products will meet your expectations.
Product warranties, if any, are provided by the U.S. retailer or manufacturer and are subject to their terms.
12.0. Indemnification.
You agree to indemnify and hold harmless Shakarra, its affiliates, officers, directors, employees, and agents from any claims, damages, or losses arising from your use of the Site or services, violation of these Terms, or infringement of any third- party rights.
13.0. Governing Law and Dispute Resolution.
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of the Site or services will be resolved through negotiation in good faith. If unresolved, disputes will be submitted to the exclusive jurisdiction of the courts in Lagos, Nigeria.
14.0. Termination.
We may terminate or suspend your account or access to the Site or services at our discretion, with or without notice, for reasons including violation of these Terms, suspected fraud, or inactivity for an extended period (e.g., 2 years). Upon termination, your right to use the Site and services ceases, but these Terms' provisions on intellectual property, liability, and indemnification survive.
15.0. Force Majeure.
We are not liable for delays or failures to perform due to events beyond our reasonable control, including but not limited to natural disasters, strikes, governmental actions, or disruptions in third-party services (e.g., shipping or payment processing).
16.0. Miscellaneous.
- Entire Agreement:These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shakarra regarding the Site and services.
- Severability:If any provision of these Terms is found invalid, the remaining provisions remain in effect.
- No Waiver:Our failure to enforce any provision does not waive our right to do so later.
- Assignment:You may not assign your rights under these Terms without our consent. We may assign our rights to a successor entity.
